Addendum A — High-Risk Provisions 24. DMCA & Intellectual Property Takedown Policy BayoSys respects intellectual property rights and expects all users and tenants to do the same. If you believe that content hosted on the Platform infringes your copyright or intellectual property rights, you may submit a written notice including: Your name and contact information Identification of the copyrighted work claimed to be infringed Identification of the allegedly infringing content and its location A statement that you have a good faith belief the use is unauthorized A statement that the information provided is accurate under penalty of perjury Your physical or electronic signature Notices should be sent to: support@bayosys.com BayoSys may: Remove or disable access to allegedly infringing content Notify the responsible user or tenant Terminate repeat infringers BayoSys is not responsible for independently verifying ownership claims but will act in good faith to address valid notices. 25. Accessibility (ADA) Disclaimer BayoSys is committed to improving accessibility across its Platform. However: BayoSys does not guarantee that all tenant-operated websites or content are fully compliant with accessibility laws or standards, including the Americans with Disabilities Act (ADA) or WCAG guidelines Tenants are responsible for ensuring their own content, services, and customer interactions meet applicable accessibility requirements BayoSys may provide tools or templates that support accessibility, but compliance remains the responsibility of each Tenant. 26. Regulated Industry Disclaimer Certain tenants may operate in regulated industries, including but not limited to: Insurance Health and wellness Fitness Financial services Medical or therapeutic services BayoSys: Does not provide licensed services in these industries Does not verify the licensing, certifications, or compliance status of tenants Does not guarantee that tenant content complies with applicable laws or regulations Users should: Independently verify credentials of any service provider Consult appropriate licensed professionals where necessary Tenants are solely responsible for: Compliance with all applicable laws, regulations, and licensing requirements Accuracy of representations made through the Platform 27. AI & Automation Disclosure BayoSys may utilize artificial intelligence and automation tools in connection with Platform operations, including but not limited to: Data processing and organization Lead generation and enrichment CRM automation and tagging Email drafting and communication workflows Intake processing Operational workflows and API execution Nature of AI Systems AI-generated outputs may be automatically generated and may not always be accurate, complete, or current Outputs may be reviewed, modified, or supplemented by human operators User Responsibilities Users and tenants agree: Not to rely solely on AI-generated outputs without review To verify accuracy before using or publishing AI-generated content To ensure compliance with applicable laws when using AI-assisted workflows Data Processing by AI Providers Data submitted to the Platform may be processed by third-party AI providers as part of normal operations. Sensitive Data Warning Users should not submit highly sensitive personal, financial, or regulated data unless explicitly required and appropriate safeguards are in place. Access Boundaries AI systems (including internal automation tools) may access operational data necessary to perform Platform functions Access to tenant CRM data or customer records is limited to authorized workflows and permissions 28. Data Processing & Business Use (DPA-Style Clause) For business customers (Tenants): BayoSys acts as a data processor for certain customer data handled on behalf of tenants Tenants act as data controllers for their customer data BayoSys will: Process data only as necessary to provide the Platform Implement reasonable security measures Limit access to authorized systems and personnel Tenants are responsible for: Lawful collection and use of customer data Providing required privacy notices Obtaining necessary consents A formal Data Processing Addendum (DPA) may be provided upon request where required by law. 29. International Use & Data Transfers The Platform may be accessed by users in multiple countries. By using the Platform: You acknowledge that data may be processed and stored in the United States or other jurisdictions You consent to cross-border data transfers where applicable Tenants operating internationally are responsible for: Compliance with local data protection laws (e.g., GDPR or equivalent regulations) 30. Lead Generation & Outreach Disclosure Certain features of the Platform may involve: Lead generation Data enrichment Outreach tools (including calling, SMS, or email automation) BayoSys does not guarantee: Accuracy of lead data Contactability of prospects Compliance outcomes for outreach activities Users and tenants are solely responsible for: Compliance with applicable laws (including TCPA, CAN-SPAM, and Do Not Call regulations) Proper handling of opt-outs and suppression requests Lawful use of prospect and customer data 31. Platform Role Clarification (Reinforcement Clause) For clarity across all use cases: BayoSys is a software platform and infrastructure provider Tenants are independent businesses responsible for their own operations Customers must contact the Tenant for service-related issues BayoSys support is limited to platform, access, and infrastructure concerns 32. Survival The provisions of this Addendum shall survive termination of use of the Platform where applicable, including but not limited to: Intellectual property Limitation of liability Indemnification Data handling obligations 33. Effective Date This Addendum forms part of the BayoSys Terms & Conditions. Effective as of: [INSERT DATE]
